By participating in the Lifetime Trade-Up Programme, clients agree to the following Terms & Conditions.
Section 1 – Eligibility
1.1 The Programme is available exclusively to members of the TMC Legacy Atelier Loyalty Programme in the following tiers: Chapter Two, Chapter Three and Chapter Four.
1.2 Only engagement rings originally crafted by TMC Fine Jewellers are eligible for the Programme.
1.3 The Trade-Up Programme applies to the replacement of the centre stone only. Replacement or modification of melee or accent stones will require a new setting and will be quoted separately at standard pricing.
1.4 The engagement ring must be in good structural condition. Normal wear and tear is acceptable; however, rings with significant structural damage may be deemed ineligible at the discretion of TMC Fine Jewellers in accordance with the TMC Lifetime Warranty.
1.5 Each engagement ring is eligible for one (1) Trade-Up only.
1.6 Wedding bands, fine jewellery pieces, or rings not originally crafted by TMC Fine Jewellers are excluded from the Programme.

2.5 Minor structural adjustments may be required to ensure the new gemstone is securely set and proportionally suited to the ring design.

Clients are required to send their engagement ring to the TMC Brisbane Head Office, either via showroom appointment or insured postage (at the client’s expense).
Upon receipt, TMC Fine Jewellers will:
- remove the original centre stone and hold it securely
- dismantle the existing setting
- refine the precious metal
- craft a new setting to match the original order specifications and suit the proportions of the new gemstone
Standard turnaround time is 6 weeks once payment has been received and all materials are available.
3.5 Completion
The completed ring, gemstone certificate (where applicable), and the client’s original centre stone will be returned via complimentary insured express post or made available for showroom collection.

7.4 TMC Fine Jewellers shall not be held responsible for damage to the original centre stone arising from pre-existing fractures, structural weaknesses, or internal characteristics that become apparent during removal, handling, inspection, or storage.

The TMC Jewellery Recycling Programme (the “Programme”) is an exclusive benefit available to eligible Chapter Four members of the TMC Loyalty Programme. It allows members to contribute gold or platinum jewellery in exchange for a pro rata amount applied toward the remaining balance of an existing TMC order. By participating in the Programme, members agree to the following Terms & Conditions.
Section 1 – Membership & Eligibility
1.1 The Programme is open exclusively to active Chapter Four members of the TMC Loyalty Programme.
1.2 Members must have an existing TMC quote or confirmed order prior to submitting jewellery for valuation.
1.3 Members without an existing quote or confirmed order are not eligible to participate.
1.4 Eligibility is determined at the time of submission and must remain valid at the time of acceptance.
1.5 Members must be 18 years of age or older and legally capable of entering into a binding agreement.
Section 2 – Accepted Materials
2.1 Accepted materials include gold and platinum jewellery only.
2.2 Jewellery may be originally purchased from TMC or from other jewellers.
2.3 Stones, diamonds, coloured gemstones, and all non-metal components are excluded from valuation.
2.4 Items must be genuine gold or platinum and free from non-precious base metals.
2.5 All jewellery must pass TMC’s verification process, including XRF or other internal testing methods.
2.6 TMC reserves the right to decline any item that cannot be properly verified.
Section 3 – Valuation & Benefit
3.1 The value of accepted jewellery is determined based on its verified metal content and TMC’s internal gold and platinum buy-back rate at the time of assessment.
3.2 The confirmed amount is applied as a pro rata reduction toward the remaining balance of the member’s specified existing TMC order only.
3.3 The maximum amount that may be applied per member under this Programme is $1,000 AUD, GST-inclusive.
3.4 The valuation rate is variable and calculated according to TMC’s internal rate and the market price of gold and platinum at the time of assessment.
3.5 The maximum recycling credit available is $1,000 AUD. Any assessed value beyond this cap will not be credited; jewellery not accepted as part of the approved recycling amount will be discussed with the member.
3.6 GST is calculated on the remaining balance of the order after the recycling adjustment is applied. No separate GST applies to the submitted jewellery.
3.7 The confirmed valuation is valid for 30 days from the date of issue.
3.8 The applied amount is non-transferable, non-refundable, not redeemable for cash, and cannot be exchanged for store credit or applied to any other order.
Section 4 – Process & 30-Day Holding Period
4.1 Enquiry & Submission: Eligible members submit jewellery in person at a TMC showroom or via secure post (at the cost of the customer).
4.2 Verification & Valuation: TMC jewellers verify authenticity, weigh, log, and assess the metal according to TMC’s internal buy-back rate and market price at the time of assessment.
4.3 Valuation Summary: The member receives a written valuation summary outlining the pro rata amount available.
4.4 Following issuance of the valuation summary, TMC will hold the jewellery securely for a period of 30 days.
4.5 During this 30-day holding period, the member may:
4.5.1 Accept the valuation and proceed with application to their order; or
4.5.2 Decline the valuation and request return of the jewellery.
4.6 If the member does not respond within 30 days, TMC reserves the right to treat the valuation as declined and arrange return of the jewellery at the member’s cost.
4.7 Once the member accepts places their order with the credit applied,
4.7.1 The jewellery becomes the property of TMC;
4.7.2 The transaction is final;
4.7.3 The jewellery cannot be returned under any circumstances;

5.2 In the event of return of jewellery (if the member declines the valuation during the 30-day period), TMC will provide signature-on-delivery and a tracking code. Members are responsible for insurance during return transit.
5.3 Once the member accepts the valuation and the amount is applied to the order balance, TMC assumes responsibility for the jewellery within its facility and supply chain, but no further liability applies for change of mind or post-acceptance return.
Section 6 – Finality
6.1 Once the pro rata amount has been applied to the order balance, the transaction is final and cannot be reversed.
6.2 The applied amount cannot be refunded, transferred, reassigned, or reissued.
6.3 If the associated order is cancelled after the recycling amount has been applied, TMC reserves the right to deduct the applied amount from any refund payable.
6.4 Jewellery that does not pass verification will be returned at the member’s cost.
Section 7 – Privacy & Data
7.1 TMC collects personal information and order details solely for the purpose of administering the Programme.
7.2 All personal information is handled in accordance with the Privacy Act 1988 (Cth) and TMC’s Privacy Policy.
7.3 Members consent to the collection, storage, and use of their information for Programme purposes, including verification, valuation, and application of the pro rata amount to the order balance.
Section 8 – Dispute Resolution
8.1 Members with questions, concerns, or disputes relating to the Programme may contact TMC’s Client Resolutions team at info@tmcfinejewellers.com.
8.2 TMC will attempt to resolve all disputes promptly and fairly in accordance with internal procedures before any external remedies are sought.
Section 9 – Limitations
9.1 The Programme cannot be combined with alternative metal trade-in arrangements unless expressly approved by TMC in writing.
9.2 The Programme does not guarantee a minimum valuation.
9.3 TMC reserves the right to amend, suspend, or withdraw the Programme at any time.
9.4 TMC may refuse participation where fraud, misrepresentation, or breach of these Terms & Conditions is suspected.
Section 10 – Warranty
10.1 Jewellery purchased under an order partially reduced through this Programme remains subject to TMC’s Lifetime Warranty and servicing terms, in accordance with standard conditions.
Section 11 – Operational Controls
11.1 All intake, weighing, and verification must be documented in TMC’s central records.
11.2 All valuations must be confirmed by two authorised team members for accuracy and compliance.
The TMC Jewellery Recycling Programme (the “Programme”) is an exclusive benefit available to eligible Chapter Four members of the TMC Loyalty Programme. It allows members to contribute gold or platinum jewellery in exchange for a pro rata amount applied toward the remaining balance of an existing TMC order. By participating in the Programme, members agree to the following Terms & Conditions.
Section 1 – Membership & Eligibility
1.1 The Programme is open exclusively to active Chapter Four members of the TMC Loyalty Programme.
1.2 Members must have an existing TMC quote or confirmed order prior to submitting jewellery for valuation.
1.3 Members without an existing quote or confirmed order are not eligible to participate.
1.4 Eligibility is determined at the time of submission and must remain valid at the time of acceptance.
1.5 Members must be 18 years of age or older and legally capable of entering into a binding agreement.
Section 2 – Accepted Materials
2.1 Accepted materials include gold and platinum jewellery only.
2.2 Jewellery may be originally purchased from TMC or from other jewellers.
2.3 Stones, diamonds, coloured gemstones, and all non-metal components are excluded from valuation.
2.4 Items must be genuine gold or platinum and free from non-precious base metals.
2.5 All jewellery must pass TMC’s verification process, including XRF or other internal testing methods.
2.6 TMC reserves the right to decline any item that cannot be properly verified.
Section 3 – Valuation & Benefit
3.1 The value of accepted jewellery is determined based on its verified metal content and TMC’s internal gold and platinum buy-back rate at the time of assessment.
3.2 The confirmed amount is applied as a pro rata reduction toward the remaining balance of the member’s specified existing TMC order only.
3.3 The maximum amount that may be applied per member under this Programme is $1,000 AUD, GST-inclusive.
3.4 The valuation rate is variable and calculated according to TMC’s internal rate and the market price of gold and platinum at the time of assessment.
3.5 The maximum recycling credit available is $1,000 AUD. Any assessed value beyond this cap will not be credited; jewellery not accepted as part of the approved recycling amount will be discussed with the member.
3.6 GST is calculated on the remaining balance of the order after the recycling adjustment is applied. No separate GST applies to the submitted jewellery.
3.7 The confirmed valuation is valid for 30 days from the date of issue.
3.8 The applied amount is non-transferable, non-refundable, not redeemable for cash, and cannot be exchanged for store credit or applied to any other order.
Section 4 – Process & 30-Day Holding Period
4.1 Enquiry & Submission: Eligible members submit jewellery in person at a TMC showroom or via secure post (at the cost of the customer).
4.2 Verification & Valuation: TMC jewellers verify authenticity, weigh, log, and assess the metal according to TMC’s internal buy-back rate and market price at the time of assessment.
4.3 Valuation Summary: The member receives a written valuation summary outlining the pro rata amount available.
4.4 Following issuance of the valuation summary, TMC will hold the jewellery securely for a period of 30 days.
4.5 During this 30-day holding period, the member may:
4.5.1 Accept the valuation and proceed with application to their order; or
4.5.2 Decline the valuation and request return of the jewellery.
4.6 If the member does not respond within 30 days, TMC reserves the right to treat the valuation as declined and arrange return of the jewellery at the member’s cost.
4.7 Once the member accepts places their order with the credit applied,
4.7.1 The jewellery becomes the property of TMC;
4.7.2 The transaction is final;
4.7.3 The jewellery cannot be returned under any circumstances;
4.7.4 No change of mind rights apply outside the 30-day period.

2.2 Donation redemption values are fixed and are as follows:
- 1,000 points = $10 donated
- 2,000 points = $20 donated
- 5,000 points = $50 donated
2.3 Points are deducted immediately from the member’s loyalty account at the time of redemption.
2.4 Point donations are non-transferable and cannot be exchanged for alternative rewards, store credit or monetary value.
3. Fulfilment of Donations
3.1 Donations are not processed in real time.
3.2 TMC Fine Jewellers aggregates all philanthropy point redemptions over the calendar year.
3.3 At the conclusion of the calendar year, TMC Fine Jewellers will make a consolidated monetary donation to its nominated charitable partners on behalf of eligible members.
3.4 Members who have redeemed points for philanthropy will be notified via email once the donation has been fulfilled.
4. Charitable Partners
4.1 Charitable partners are selected solely by TMC Fine Jewellers and may change from time to time at its discretion.
4.2 Donations cannot be redirected to alternative charities, organisations or causes outside of TMC’s nominated partners.
4.3 TMC Fine Jewellers does not guarantee specific outcomes, use of funds or impact reporting from charitable partners.
5. Restrictions & Conditions
5.1 Once points are redeemed for a philanthropic donation, the redemption cannot be reversed, refunded or reissued.

7.1 Participation in the Legacy Atelier Philanthropy Program constitutes acceptance of these Terms & Conditions, in addition to the Legacy Atelier Loyalty Program Terms & Conditions.
7.2 In the event of any inconsistency between these Philanthropy Terms & Conditions and the general Legacy Atelier Loyalty Program Terms & Conditions, these Philanthropy Terms & Conditions shall prevail.
